Please read through the following Terms and Conditions which apply to your purchase of clothing, accessories and other goods {"goods"} from the Beautiful Soul website at www.beautiful-soul.co.uk {the "website"}. You shall be responsible for reading and understanding these Terms and Conditions, and we do not accept responsibility for any loss or damage incurred by you or any third party as a result of your failure to do so.

The website and goods are provided by Beautiful Soul Ltd, {"we", "us", "our") a company registered in England. When we refer to "you" and "your" we mean the user of the website and purchaser of goods. 

These Terms and Conditions form a legally binding contract between us and you and your acceptance of the Terms and conditions is given when you purchase goods from us. You should read these Terms and Conditions carefully before buying anything from this website and agree with and accept all of the terms contained in this agreement and our Privacy Policy.

We reserve the right to change the Terms and Conditions under which the website and the goods are provided. Any such changes will be effective to all new orders once included in the text of these Terms and Conditions and published on the website. You should check the terms posted on the website periodically to ensure that you are aware of and comply with the current version. INFORMATION ABOUT THE WEBSITE AND THE GOODS

This part sets out some terms about information on the website, descriptions of goods and how you use the website.

All products displayed on this website are available only whilst stocks last.

Every effort has been made to reflect product colours as accurately as possible. However, due to factors such as differences in monitors and screen settings, we are unable to guarantee that the colour you will see on your monitor will accurately reflect the true colour of the product.

We try to make sure that all information on the website, including descriptions of our goods, and listed prices, are accurate and correct at all times. However, mistakes do happen. We will try to resolve all information errors on the website as soon as reasonably possible, and if we reasonably think that such an error has affected your purchase of goods we will try to let you know. However, because we take these steps we will not be liable to you for any errors on the website.

You should bear in mind that buying clothing and accessories over the internet provides a different shopping experience to buying in-store. In particular you acknowledge that:

  • The colours which are shown for the goods on the website will depend on many factors including your display settings;
  • All sizes and measurements are approximate;
  • All goods are subject to availability - we may not be able to supply your order;
  • Any delivery estimates given on the website or by email are estimates only.

You are responsible for ensuring that your login details, password and all other details in relation to your account remain confidential at all times.

PURCHASING GOODS ONLINE

This part sets out some terms which apply to your purchase of goods from us through the website.

You make an offer to purchase a product from us {your "order"} by completing the staged process on the website as set out below:

All transaction information passed between the website and Sage Pay’s systems is encrypted using 128-bit SSL certificates

  • Enter login details
  • Enter billing address details
  • Enter delivery address details
  • Confirmation of order

Your order only constitutes an offer to purchase goods from us, and does not form a binding contract until accepted by us. Where you order more than one product your order contains a series of offers for each product individually. On receipt of your order, we will send you an order acknowledgement email to the email address which you provide in the order process.

This order acknowledgement email will contain your order number and details of the goods ordered. Note that this email is only to acknowledge that your order has been received, and is not acceptance by us of any offers to purchase goods.

We must receive full payment of the price of the goods before we can accept any offers. Where you select to pay by credit or debit card we will process the payment at the time of preparing your goods for despatch.

An offer made by you to purchase a product shall only be deemed to be accepted by us when we despatch that product to you and send you an order despatch email which includes details of the product. We reserve the right to refuse any offers in an order prior to acceptance. If a product is not available we will include details of the unavailable product in the order despatch email. A product which is not available will not be included in the contract for a product which is despatched.

All prices on the website are in the currency appropriate for the country selected on the website: GB Pounds, Euros and US Dollars and are charged in GB Pounds within the checkout.

Delivery charges will be applied based on the delivery address chosen and these will be displayed in the order process. Prices quoted in GB Pounds and Euros include VAT at 20% {UK Tax} and are subject to change if the applicable rate of VAT changes before your order is accepted. Where products are delivered to you outside of the UK and European Union a VAT deduction will be applied within the checkout upon entering a valid delivery address, and your package will be sent DDU {Delivery Duty Unpaid}; you will be responsible for paying any local sales tax or import duties arising at the delivery destination, which are not included in the price of the products. We recommend you contact your local customs authority to determine a landed cost price prior to order completion. 

For purchases made during an exclusive or public flash sale, goods can be returned but only for a gift card or exchange.  

PURCHASING PRE-ORDERS AND MADE TO ORDER ONLINE

Pre-Orders and Made to Orders are non-returnable, non-exchangeable and must be agreed to and paid for in full via the website checkout before orders can be engaged and for production to commence. 

We will send you an order acknowledgement email to the email address which you provide in the order process. 

Pre-ordered items will be charged in full and made to order for you as soon as the order is placed and payment cleared. Once your order is ready we will be able to ship your item directly to you. If you combine your pre-ordered item with items currently available the order will be shipped separately but you will only pay one shipping fee.  

CANCELLATIONS

Customer satisfaction is always our top priority and as such we handle each query on an individual basis to the best of our ability. If you notice that you accidentally made a mistake while placing your order and wish to cancel your order, please do not hesitate to contact us.

DELIVERY

Delivery times are subject to stock availability, and to possible delays due to credit card authorisation, compliance with customs controls and other factors outside our control.

We will only ship to countries featured in our shipping list, and will not honour orders requiring delivery to any destination outside the countries listed. Please note that we do not ship to PO Boxes. We will take all reasonable steps to deliver your goods within 30 days of your order, unless we have agreed a longer period with you. We can take no responsibility for any delivery problems arising from incomplete or incorrect address details supplied by you.

All deliveries are sent via the Royal Mail and require a signature, so please ensure somebody is in to sign for the goods. This is subject to the Royal Mail’s First Class Postal Service. We will email you when your order has been despatched with your Royal Mail Tracking Number. Please see below for their Terms and Conditions.

RETURNS AND EXCHANGES

We are committed to ensuring the highest level of service.

Whilst hoping that you are delighted with your order, if you are not perfectly satisfied with your goods we will gladly offer you a full refund or exchange.

Please notify us by email of your intention to return the goods within 7 days of receipt and we will issue instruction and a refund upon receipt of the item{s}, subject to the Terms and Conditions detailed below.

We must however stress that in order to receive a refund or exchange, the item{s} must be unworn and in perfect condition, with all garment tags still attached and in their original packaging. Please handle all items with care and when trying on item{s} of clothing please do not use unnecessary force and ensure that you are not wearing make-up, perfume or deodorant which may leave a scent or marks. We will be unable to accept the return of any item{s} where these instructions have not been followed and we reserve the right to refuse a refund or exchange for any items which we deem unfit for resale.

Your replacement item{s} will be sent to you on receipt of the original item{s} being returned. If an item has been reduced in price there will be no credit.

Full refunds denote item value only and exclude the delivery charge, import duties, customs and local sales taxes. If you are returning products please remember they are your responsibility as a customer until they reach us. For your own protection we recommend that you send any returns using a delivery service that insures you for the value of the goods. We do not pay for return postage, this will be at your own cost.

FAULTY GOODS

Beautiful Soul Ltd prides itself on outstanding quality and regularly conducts quality checks of stock. However, if you believe you have received an item with some kind of fault, please notify us by email within 7 days of receipt of the item, with full details of the fault and we will advise you how to proceed.
